The penalties a Californian will face for a drug-related conviction depend in a large part on what the defendant does or does not do with the drugs. Some categories of drug crimes are:

  • Possession of drugs with the intention to use them personally. Many possession charges are misdemeanors. However, the penalties can vary based on the type of drug, the amount the defendant has, and the defendant’s prior history. Certain aggravating factors can upgrade possession penalties to felonies, especially prior drug charges or possession near a school.
  • Possession of drugs with the intention to sell This is a more severe charge, and it is always a felony. Marijuana is included under this law for anyone without a license to run a dispensary.
  • Distribution, transportation, or sale of drugs. This is a felony, and it carries lengthy prison sentences and severe fines. The penalties are harsher if certain aggravating conditions are met, such as moving drugs outside of one’s own county or involving a minor in the process.
  • Drug manufacturing. It is a severe felony to be involved in the chemical creation of a controlled substance. Some factors that make the penalties worse can be if the manufacturing is a risk to public health (such as having a home “lab” to make drugs), if you were manufacturing drugs near children or a school, or if you have a prior offense.
  • Drug trafficking. This is when a defendant transports drugs, especially in large amounts, across state or federal borders. This is a federal felony.
